Supreme People’s Court Released Typical Cases Supporting Hong Kong Arbitration
On September 5, 2024, the Supreme People’s Court released six typical cases supporting Hong Kong arbitration, showcasing the court’s commitment to legally supporting and efficiently handling various types of judicial review cases related to Hong Kong arbitration. Since 2019, mainland courts have handled over 1,000 judicial review cases involving Hong Kong arbitration. As of April 2024, the Hong Kong International Arbitration Centre (HKIAC) alone had submitted 119 applications for preservation assistance to mainland courts, involving a total amount exceeding RMB 30 billion. Mainland courts have processed these applications and executed preservation measures within an average period of 28.3 days.
The six typical cases released this time cover a range of issues, including applications for confirmation of the validity of arbitration agreements involving Hong Kong, preservation cases assisting Hong Kong arbitration, and applications for recognition and enforcement of Hong Kong arbitration awards. These cases vividly showcase the judicial stance of the Supreme People’s Court in supporting Hong Kong arbitration and promoting the high-quality development of international arbitration.
The release of these cases serves three main purposes: firstly, to ensure the smooth progress of Hong Kong arbitration through convenient and efficient preservation assistance; secondly, to encourage and support parties to choose Hong Kong arbitration for dispute resolution; and thirdly, to facilitate the cross-border enforcement of Hong Kong arbitration awards.
